What is an industrial design?

An industrial design is the visual features of shape, configuration, pattern or ornament—or any combination of these features—applied to a finished article made by hand, tool or machine and The registration of industrial design gives its owners the exclusive rights to exclude others from reproducing, importing or selling or offering for sale or distributing the protected design.

Summary

Designs and industrial models are protected in Algeria through registration with the competent office documents must be submitted to the INAPI (the Algerian National Institute of industrial property ).

A design or industrial model registration is valid for 10 years from the date of filing application

Requirements

  1. six identical copies of the representations of the design. Pictures of the design are requested instead of the short description of the design.
  2. declaration of priority :
    1. if the applicant claims the right of priority a national application in Algeria must be filed within 06 months from the date of filing of the earliest application in any country of Paris Union.
    2. a declaration of priority and payment of priority fees is requested at the moment of filing, and a certificated priority documents may be submitted within 03 months from the filing date.
  3. An explanatory legend explaining the novelty of the design and figures/pictures of each design.
  4. A simply signed Power of Attorney NOTE: POA should be filed with the applicant’s name and address as mentioned in the instruction letter, signatory name and position, dated and signed.
